What personal information we collect
We collect the personal information we need to advise you and to run an IVA: who you are and how to reach you, your money, your work and your household, and in some cases your health.
| Information | Examples | Why we need it |
|---|---|---|
| Personal details | Name, age, date of birth, passport or driving licence | To identify you and keep in touch. You cannot opt out of giving it. |
| Financial information | Income, spending, assets, debts, bank statements, benefits, payslips, tax returns, county court judgments, credit history and credit reference information, bank and debit card details | To set up and supervise an IVA, review your circumstances and pay your creditors. You cannot opt out of giving it. |
| Employment information | Employment status, occupation, pay date and salary | To work out which debt solutions may be open to you. An IVA needs it. |
| Household information | Marital status, the number and ages of children who depend on you, your household | To work out what you can afford to pay. An IVA needs it. |
| Health information | Physical or mental health conditions or disabilities | To see whether you may need extra support. You can choose not to give it, though that may affect the help we can give and whether an IVA will work. |
We get this information from you, from anyone you appoint to act for you, and from your creditors, your bank, credit reference agencies, legal parties or law enforcement. Occasionally a health professional tells us about a condition.
Our main lawful basis is the contract between us, because we cannot provide the service without your information. We also use it to meet legal and regulatory duties, verify your identity, keep records, process payments and prevent fraud and other crime. We ask for your explicit consent before we record health information or use your details for direct marketing.
We share information only where the service needs it or the law requires it: with your creditors; with a credit reference agency to verify your identity, which usually leaves a soft search on your credit file; with the police, regulators or government agencies when we have to; and with carefully chosen suppliers who help with identity checks, quality monitoring, scanning, printing, audits and record keeping. If you want a partner or carer to speak to us for you, we need your separate consent, and you can withdraw it at any time.
Some of the software we use may store information on servers outside the UK, protected by appropriate technical and organisational security measures. We keep your information for no longer than 7 years after the service ends, for legal reasons and to protect everyone involved.
This website does not set cookies, and it does not use advertising or analytics tools. If that changes, we will update this policy first and ask for your consent where the law requires it.
Your rights
You have the right to ask for a copy of the personal information we hold about you, to have it corrected, and in some cases to have it deleted, restricted or no longer used.
- Access: ask for a copy of the information we hold about you.
- Correction: ask us to correct information that is wrong, incomplete or out of date.
- Deletion: ask us to delete information we no longer need, that we hold only with consent you have withdrawn, that you have validly objected to, or that we should not be using by law.
- Objection: tell us to stop using your information for direct marketing, at any time.
- Restriction: ask us to limit how we use your information, for example while we check that it is accurate.
- Automated decisions: ask for a person to review any decision made about you by automated means that significantly affects you.
- Consent: withdraw consent you have given, and we will stop using the information for that purpose.
To use any of these rights, contact the Data Manager using our phone, email and office details. A paper copy of this policy is available on request.
If you are unhappy with how we have handled your information, please tell us first so we can put it right. You also have the right to complain to the Information Commissioner's Office, which recommends raising a concern with the organisation first (opens in a new tab); its helpline is 0303 123 1113.
This policy replaces the privacy notice we last updated on 24 May 2018.
